A debt management plan is a debt consolidation scheme. It is administered by debt professionals who act on your behalf and deal with creditors in an attempt to resolve financial difficulties. Debt management companies act as an intermediary between individuals and their creditors and seek to renegotiate the debts. The individual must provide information not only of the creditors but also monthly income and expenditure so that an affordable repayment schedule can be reached. This monthly payment is made to the debt management company who then in turn shares I equally out amongst the creditors.
The debt management company when organising a debt consolidation plan will aim to
- Reduce the overall level of debt
- Freeze all interest charges
- Set up a revised affordable monthly repayment over a longer period
- Prevent creditors from taking legal action
Although a debt management company will endeavour to obtain the best result possible for their client, there is never any guarantee they will be successful when negotiating with the creditors. A debt management plan is not legally binding on the creditors.
In the event of a successful negotiation the individual after agreeing revised repayment terms must meet all repayments in full until the debt has been completely cleared or until they are able to make full repayments again. Throughout a debt management plan an individual should not incur further credit as they may find the whole situation breaking down and requiring more urgent financial solutions such as bankruptcy being administered.
There are two types of debt management companies, those that take their fees from the monthly repayments paid by the individual to the creditors and those that are paid by the creditors.
Debt management plans do not tend to give a final settlement of their situation however there are exceptions to this. They tend to be most beneficial when other options are not available or as a temporary solution to allow an individual to resolve their debt situation by other means.
